Spouse visa - living apart

Hi,


My wife intends to apply for a Spouse visa, who is currently living in China. I am a British Citizen living in the UK. We are living apart since 2011 due to the fact she will need to look after our daughter and I was not earning enough money.

Now we think we are ready. However, I am concerned that we are living apart for more than 7 years, would it increase the chance that her spouse visa application can be refused? Appreciate that there are not many people having the same problems..

What evidence of visits and communication and subsisting marriage do you have?

You will have to apply for the same visa for your child. Both mother and child will require 5 years residence (2 x 2.5 year visas) before they can apply for ILR again.

Current visa fee each is £1523 PLUS £600 each Immigration Health Surcharge (health surcharge increasing in December apparently).

Do you earn a minimum of £22,400 pa??

I fly back home once a year for family re-union, and we have had summer holidays together abroad. Communication is phone calls roughly on daily basis. We live kind of independently financially.

Would that be sufficient to confirm that our marriage is genuine?

Yes, I understand that they have to apply for the visa at the same time. Yes, I am earning more than £22,400 a year.

For a 7 year apart marriage you will need substantial amount of docs to backup that the relationship is genuine and subsisting.

You will need to show for example travel iternary, gifts sent, financial support i.e money sent, visits, call logs, photos etc covering your whole relationship.
