Job offer letters

Job offer letters

Hi, my Son will soon be returning to the UK from the USA and wishes to bring his soon to be Wife whom he met in the USA to settle with him. His problem is that when he returns he will be unemployed and so unable to meet the financial requirements for the spouse visa. They do not wish to be apart for the six months plus the visa processing time that is necessary once he gains employment at the 18.6k mark. We have been advised that if he receives a job offer letter meeting the requirements before he returns to the UK that would be evidence enough for them to submit the application straight away. My question is, it makes no sense to me that the Home Office will accept a job offer letter before he comes home, but not after he arrives and instead would require him to work 6 months at 18.6k , is this correct or would they actually accept a job offer letter when he is in UK in order to start application sooner?

There are two mandatory parts of meeting the requirements in this way.

He must be able to prove that he meets the equivalent of the financial requirement with overseas income AND have a confirmed job offer to start within 3 months of returning the UK at the required stated level.

If he has substantial savings, he could of course use that on its own.

I will wait for senior members to comment, but I do not believe a job offer is sufficient proof for meeting financial obligations. If he doesn't hold UK passport, he could look at getting Tier 2 Visa sponsored by employer and bring his wife on Tier 2 (dependent) visa.

If your son is already working in USA earning more than equivalent £18,600 and the job offer letter from UK has a salary of £18,600 then he can use this. Otherwise, he will need to show savings of £62,500 through CAT D or just work 6 months whilst back in UK at a salary of £18,600 p/a and then sponsor the wife.
