Set(LR) 2018 dependent came b4 July 12

Post by Saim01 » Mon Oct 22, 2018 1:33 pm

Dear All,
This question may have been asked before but I didn't get the answer. Your help is much appreciated. I just got my ILR recently on Oct 18 on set LR basis. My dependent join me in March 2012 as Tier 2 dependent. The immigration history is as follow:
I came in sep 2008 as Tier 4 student then PSW (valid till 20/01/11) and then switch to tier 2 valid till (07/11/12) rest is provided below till June 2019.
Dependent came to this country on 21st March 2012 as PBS Dependent of Tier 2 migrant valid until 07/11/2012. The main applicant switched to Tier 4 visa, and dependent switched to Tier 4 dependent. Following are the start and end dates of visas including current Tier 2 dependent expiring on 4th June 2019.
# Visa Type Start Date End Date
1 Tier 2 Dependent 06/03/2012 07/11/2012
2 Tier 4 Dependent 29/01/2013 22/01/2016
3 Tier 4 Dependent (extension) 02/02/2016 28/01/2017
4 Tier 4 Dependent (Doctoral Extension Scheme) 07/03/2017 17/01/2018
5 Tier 2 Dependent 09/08/2017 04/06/2019

Main applicatnt, I got ILR this month.
1) Can my dependent (spouse) apply for Indefinite Leave to Remain (ILR) under section 281-287 (2-year route for PBS dependent came before 9 July 2012)?
2) Is the time spent under Tier 4 Dependent and Tier 4 (Doctoral Extension Scheme) counted towards PBS Dependent immigration?

Regards
Saim

Presumably you applied for and got ILR based on 10 years long residence correct?
1) Can my dependent (spouse) apply for Indefinite Leave to Remain (ILR) under section 281-287 (2-year route for PBS dependent came before 9 July 2012)?
If yes to my question above, then no to your spouse ILR question. She has to apply for FLR(M) spouse visa and meet the English and financial requirement. This will reset her clock for ILR based on 5 years residence.
2) Is the time spent under Tier 4 Dependent and Tier 4 (Doctoral Extension Scheme) counted towards PBS Dependent immigration?

Not relevant if you got ILR based on 10 years long residence.

Then your spouse is NOT able to apply for ILR based on PBS Dependent visa.

Spouse must switch to FLR(M) and meet the Financial (£18,600pa) requirement and the English requirement.

Hi,
I got ILR on 10 years long residency. My last visa was t2 valid till June 19.
I already applied for my kids registration and passport.

Is it OK if my wife stay on her current leave t2 dependent until it expires in June19? Is it ok to travel on her current leave? If we don't change until june 19.

Then we switch to flrm as one extension in flrm in this way allow her ro meet 10 years LR requirements.

Probably okay to remain. But risky to travel.

You should try apply for FLR(M) sooner if you can. IHS is doubling on 8th January and an FLR(M) will cost £1000 plus visa fee of £1033 if you wait to apply.
