Online ILR application: Simple confirmatory questions

Dear all,


I have partially completed my online ILR application. I have a few simple questions about it. UKVI plays a bad game with the use of English and I do not want to take any chances. I hope someone could confirm that my answers are correct.


Background:
Entered on Tier 4 student visa on 19-Sep-2010
Got PSW on 14-Aug-2012
Got Tier 2 G on 15-Jan-2014 (this is the date of issue on my Biometric card)
Tier 2 valid until 14-Jan-2019
Applying for ILR on or after 18-Dec-2018


1. When did you first entered the UK?

Is this the 'date of issue' on my biometric card? I don't recollect getting any "letter of approval". If I do search this letter, however, is there a possibility that it can have a date earlier than that on the biometric card? If so, can I use the date on the letter?

I have entered 15-Jan-2014 on my application (date of issue of my first T2G biometric card).


2. Have you spent any of your continuous period with "leave to enter" or remain in the Crown Dependencies?

I believe I can always travel to the Isle of Man with my current leave to enter or remain. However, I have never visited any of the Crown Dependencies. What's the answer?

I have entered 'No' on my application.


3. Since you first entered the UK, have you had any absences from the UK?

I have visited India once when I was on a PSW visa. Is it correct that I do NOT have to enter the absences before my T2G visa was granted?


4. What was the reason for this time spent outside the UK?

Do I need to specify that I was on annual leave?
My 3rd visit actually had a week of sick leave as well. Do I need to do anything about it?

I have entered the reasons as "Birth of my daughter in India on dd-mm-yyyy", "Sister's wedding on dd-mm-yyyy" and "My wedding on dd-mm-yyyy".


5. Evidence of your absence from the UK?

Is it correct to select "Letter from the employer detailing..."?
Can someone direct me to a good format of ALL the letters required from the employer?


6. A penalty for a driving offence.

I'm the owner and main insured person for my car. My wife is an additional driver. She once had a parking ticket issued for incorrect parking in the employers parking space and 2 weeks ago managed to bump into the car in front of her. A passenger in the other car has made a claim.

Do I need to mention these on my application?


7. Passport:
Issuing authority: On your passport this could be referred as 'country of issue' or 'place of issue'.


I have an Indian passport. The place of issue of my (renewed) passport is Birmingham. This was done by Consulate General of India, Birmingham UK.

I have entered 'Birmingham' as an answer as that is exactly what my passport says in front of 'Place of issue'. Should this be okay?


8. Additional applicant

There's an option to add additional applicant on the online ILR application. My wife and daughter will be eligible for ILR in May 2019. They will need to apply for a T2G dependent extension to extend their stay from 15-Jan-2019 to May-2019. I plan to post my ILR application and their T2G extension application together - on or after 18-Dec-2018.

Do I need to add them to my current online ILR application or do they have to go to a separate online place somewhere on gov.uk and create a new application?


9. Public funds

Am I right in stating that the Childcare vouchers we receive from our employer to pay for the nursery do not constitute as a benefit?


10. Verification consent

None of my documents will have joint account holders. As such, I will print and send only the first page of the consent letter. Is this correct?


11. Date of application

I believe I can complete and submit the ILR application today, but send it by post (or attend in person) after I become eligible (18-Dec-2018). My ONLINE application submission date will not be considered as the application date. Is this correct?

It further says:
"If you choose Standard Service, you must send your documents within 15 days to the address on your supporting document checklist (provided when you have completed your application payment).
I am planning to complete this today but not send it until 18th Dec. Is that a problem!?

I am doing this well in advance because I want to:
1. Identify and rectify any potential issues before time.
2. Apply for and send my dependents' T2G ext application asap (with me on 18th or 19th Dec) so as to avoid the additional IHS fees if enforced on or after 19th Dec.
3. Keep the possibility open to book the same day appointment for my ILR application.


12. What proof!?
For the period before you were granted leave as a Tier 2 migrant, documents showing that you met the relevant requirements of the immigration rules.


I had to return my PSW biometric card and there is no sticker for PSW on my passport. What "proof" can I supply??


13. Premium Service Centre

a. Can I select an appt available in city X and then change it to city Y later (if one becomes available?).
b. Can I pay Standard application fee today and 'upgrade' my application to Premium later?
c. Any tips on how can I get a Premium appt? Link to other topics on immigrationboard?

2. If you have not been in the Crown dependencies, then obviously the answer would be NO.

3. Presumably yes.

4. Was the absence while on tier 2??

6. No.

7. You state : "Consulate General of India, Birmingham UK"

8. No you don't add them as they are not applying for ILR. Theirs is a separate form.

9. No.

10. Yes

11. If you submit and pay today and apply by post, today will be your application date, which means you are applying too early.

12. None required if you are applying based on 5 years Tier 2.

13a. Yes.
13b. Yes, if HO accepts your upgrade request.
13c. Many very recent topics. Search the forum. Many are having problems. System of premium service is also changing in the next month or so.

The complete question is:
When did you first enter the UK?
This is the date you entered the UK when the period of stay you are basing this application on started.

My ILR application is based on T2G 5 years route. My T2G started on 15-Jan-2014 - when I was given the Biometric card for T2G. Some topics suggest that my answer should be 15-Jan-2014 and not 19-Sep-2010 (the actual physical date when I first entered the UK as a student).


4. Was the absence while on tier 2??
0 absences when on Tier 4 student
1 absence when on PSW
3 absences when on T2G (the ones that are outlined above - and I reckon these are the only ones I need to specify?)

Thanks for the format. I never said I didn't have any absence. I am unsure if I should include 3 or 4 of my 4 absences.

So is the date of payment considered as the application date? What if I make payment on 10th Dec and send by post on 19th Dec. Is my date of application 10th Dec in this case?
If it is 10th Dec, then I cannot pay £2389 and try to upgrade before 18-Dec (my eligibility date). This is because I may not get any appt which is already so difficult. How does this work?

NO, as I have already said.

If you submit and pay online and apply by post, you only have 15 days to send your supporting documents. So applying and paying now is too early. No one is able to book December appointments as of today due to the whole system changing in November, we do not know the final details as yet.

All clear - thanks very much!

I will NOT make the payment today. I will do the online payment and postal applications on 19th Dec. I'm hoping that the IHS fee does not increase shortly before this date..
