Cooling off period for Tier 2 ICT switch?

Post by Phyber » Sun Oct 28, 2018 11:11 pm

I am on a Tier 4 Student visa that expires in May end 2019 and my wife is on a Tier 2 ICT visa which expires in June 2019. We are both in UK now. Since her work order is until December 2018, we are thinking on switching her to a dependent visa so that she can continue here and work for her client company here. That should be good until May end when my BRP expires. If her client company sponsors her a Tier 2 General visa later, will she be able to apply or does the 12 month cooling period apply in this case?

12 month cooling off applies. She would need to be on a dependent visa for 12 months or wait 12 months from date of visa switch and if not for 12 months, leave the UK and apply for tier 2 after 12 months from date she got dependent visa.
