Child Visa - Father Tier 2 Sponsored, Mother Tier 2 Dependant - Both Australian

Post by DrAMephesto » Tue Oct 30, 2018 12:49 pm

G'day All!

I'm very confused.
I've been trying to understand all the UK Immigration BS, but, clearly I'm not destined to understand them.

Long story short.
Father - Australian - Tier 2 Sponsored - 6 months in, 4.5 years left. No ILR.
Mother - Australian - Tier 2 Dependent - 6 months in, 4.5 years left. No ILR.
Child - Born 12/10/18 - Australian? British? Alien? No idea.

We haven't registered her yet, figure we've got to do that sometime, my wife knows all about it, I guess we just go somewhere and fill in some paperwork to get a real legit Birth Certificate.

But what I'm really interested in is, what do we do in regards to her Visa? Does she need a visa? Because we're both Australian, does that change things? Does she automatically become a dependant of mine and just get a visa? Do we have to apply for a visa and fork out the thousands of pounds for her??

We're looking at heading home for a month in March, so I'd like to get things sorted soon, as I don't really want to come back at the end of our trip and Border Control decide she doesn't have a visa and can't re-enter the country....

Any information would be appreciated!

Cheers.

Child is not British, as neither parent is settled nor British. Child is Australian.

They ignore the child born in the UK Rules and expect child to apply for a PBS dependant leave.

Apply before the immigration health surcharge increase.

The birth is registered at the council registry office and there is a time frame within which it must be done.

Child is not British.

So will be Australian and need an Australian passport.

She does not automatically become your visa dependent. You have to apply for a tier 2 dependent visa and pay the visa fees and IHS etc.

Cheers for the speedy replies!
If I'm reading this correctly, I can apply for the child to stay.
So I then go to here and look at the "Apply in the UK" section, and it only mentions Extending or Switching to a Tier 2.

Am I missing the part where I can start an application for the child?

I read here that I can use 'form FLR(FP)' as both parents have permission to stay in the UK.

Am I on the right track?
Where do I go, or how do I actually start the application process?
I'm sure this is easier than I'm making it, but in my line of work we dig holes and blow stuff up, we don't do immigration and endless paperwork...

Appreciate the help!

The first "here" link is correct and if you scroll down, you get to the link below if you click on "child" applying within the UK.

https://visas-immigration.service.gov.u ... dant-child

You cannot apply for FLR FP as this is not relevant to you as both parents hold pbs route visas.

Slightly off-topic, but also on topic.

Currently living in the UK. Thinking about heading back to Aus in March 2019 for a visit.
Does child need visa/passport by then?

I feel like it's a dumb question, and the answer to both is a resounding 'yes'

Also feels kinda pointless as facial features will have changed by then compared to photo taken now for applications, so it would be quite difficult to prove it's the same child.
When they look at the child vs the photos on the visa/passport, they would be vaguely similar, but could also be many other children at the same time.

Yes the child needs a passport to travel out of the UK.

Visa can be applied either in the UK or from home country.
