FLR(M) Birth certificate required of both parents?

Post by jenik » Fri Nov 02, 2018 11:48 am

Hi all,

Couldn't find an answer to my variant of this question, so registered to ask, and apologies in advance if it's been answered elsewhere already

We're about to file an FLR M for my wife, after her first 2.5yr period in the UK has ended. I am a naturalised UK citizen (2014). We recently had a child. The child is a UK citizen through me, so she is not on applying with my wife. We are doing the online application, and it is asking for "Birth certificate of both of Ms ____ parents".

I do have my birth certificate from a non-english speaking country and if necessary can get a certified translation of it. But as I was not asked it for my ILR, citizenship, or passport (in fact I have *never* been asked it in any of the numerous countries that I've worked or lived in, ever), and am having a hard time imagining that the intent is to ask, say, UK-born uk citizens for their birth certificates in addition to their passports.

Thanks for any light you can shed on this, and appreciate the work you do here.

Hi Jenik,

I am in a similar situation and the only difference is that I don't have my birth certificate to hand. Getting it will be next to impossible unless I travel to the country I am born in, get it translated and authenticated in English which is not possible within 10 days as the visa for my spouse is running out.

I have also been asked to provide the birth certificate of my ex-partner as 2 of my other children are not applying in this application as they are British National. I don't understand the logice of this birth certificate request for an ex-partner which is ridiculous as we have been divorced for 9 years and I don't know where she lives.

Anyone provide answer to the above would be highly appreciative.

Yes asking birth certificates along with passports is really very funny. But we never heard/seen any refusal due to absence of these.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.

Hi Seagul,

Thank you for your reply. So if I tick these boxes which are required in order for me to proceed with the application and if I don't provide the birth certificate but do provide my passport and the british passport copy of every page of my husband would that be enough. I will be providing the birth certificcate of the 3 Birtish children and also the birth certificate and the custody order of the court for my 15 year old son.

I will also be providing them with the divorce certificte of mine and of my husband. Do I have to write a letter to explain that I don't have my birth certificate to hand and that we don't have birth certificate of my husband Ex wife as we don't knwo where she lives and have no contact with her.

Would the letter be necessary or shell we just no provide these.

Thanks

Farida

Hi
I am in a similar situation i.e. do not have ex's birth certificate, utility bill or details of child's passport. I would appreciate your help in this matter.

I did not provide my wife's birth certificate for visa extension as didn't have one - just put a cover letter explaining she has never had one . I said they can check her passport and national identity card for proof of DOB if required.

Visa was granted a week ago.
