Received my PR few days ago, can I register my child as British?

Post by Ali12035 » Tue Aug 07, 2018 9:48 am

My child is non EEA family member of EEA citizen who is from my previous marriage. I’m holding PR from 31 may 2018 and my EEA wife holds PR in same date.

My child is living here since last 3 years he is 11 yeas old

When we can register him as British citizen?
Or we apply for naturalisation that he can apply ?

Thanks

When the child has PR and also only once you are already British or if you are applying at the same time but child needs PR first.

Naturalisation MN1 (child) Home Secretary’s discretion 3(1)

Post by Ali12035 » Fri Nov 02, 2018 6:27 pm

Hello to all Gurus,

Very helpful using since last 5 years.

I have question regarding my Non EEA children’s registration as British under MN1 Section (3)1.

1. My children under 18 years old are from my ex wife and they join me and my EEA citizen wife on September 2015 as family member of EEA citizen and they holding UK residence card valid until September 2021.

2. I myself non EEA family member and my EEA wife holding Permanent Residence Card from May 2018.

3, I’m going to apply for naturalisation in June 2019 and my EEA wife just keeping her status as permanent residence.

Is this possible to apply for non EEA children as British registration before 5 years of residence in uk while one parent is applying for British citizenship and other holds permanent residence card?

I can see MN1 guide page 14 it gives some hints but not very clear and hoping that gurus will help.

Thanks

How old are the children??

Children born abroad require PR first And can only apply If they hold PR and the parent is applying too.

Do you have sole responsibility and custody of the children?? Usually the other parent not applying at the same time is expected to hold PR too.

Thanks for your reply Cr001.

My children are 17, 15, and 12.

Yes I have court order for children and only mother can visit them on Sunday 8 hours.

Can you explain me page 27 to 32 please
