Hello & Good Afternoon (we would sincerely appreciate if anyone is or has been in a similar situation to us to give us some advice)
Firstly just some general background and apologise in advance if this is too long! we did not use a lawyer/solicitor for my husband's application; and he received his Spouse Visa in 2015. However, unfortunately his son's (my step-son) application also made at the same time 2015 (we could only afford to do one application at a time' and if my step-son got through, then we would apply for my step-daughter to also come to the UK) was refused, based on sole responsibility, which we did not prove and did not appeal. My husband applied for a further 30 months Spouse Visa in January 2018 and was successful. My husband is truly the sole responsibility for both his children and sends maintenance money to his mother. The children's mother has relinquish all her duties as a mother and does not want anything and has not provided anything to do with the children since 2012 and is more than happy to provide us with an affidavit/sworn statement. Before coming to the UK my husband left his children with his sister and his mother. My husband and myself provide clothing, school wear, shoes etc for the children. The children's mother is now long term sick and has frequent trips to the hospital and definitely is in no position to look after the children (age 11 and 13 respectively). His sister is emigrating to the USA in December and his mother is not very well and has said she will not be able to care for the children. The children have been complaining of neglect and physical abuse particularly from their step siblings and are very distressed.
We know it has been over 3 years since we last put in an application for family settlement for his son and we now need both his children to be here with us. Can anyone please Kindly let us know what evidences we need
to provide?
I guess we need to first mitigate the points of his son's refusal application on sole responsibility, before an application for family settlement can be made.
