Category B confusion

Post by naija99 » Mon Nov 05, 2018 2:11 pm

Hello Forum, please could someone advise if Cat B is met under these circumstances for a friend:-

He has been employed since 1999 for the same employer. He is permanent.
The payslip shows £8.01 per hour and contracted hours are 37.5 which equates to £15,619.50 per annum HOWEVER he no longer has his contract and his employment letter and payslips do not state the contracted hours.

My friend always receives £350.00 per month inner london waiting which shows on all wage slips and he ALWAYS does overtime which is paid at time and a half. He also gets paid for unsociable hours.
His p60 for 2016 is £32k,
His p60 for 2017 is £36k
His p60 for 2018 is £33k.

His gross monthly income for the last 12 months are as follows:
Dec 2017 gross £3102.37 net £2383.09
Jan 2018 gross £2017.22 net £1645.15
Feb 2018 gross £2467.46 net £1951.17
Mar 2018 gross £2816.79 net £2188.98
Apr 2018 gross £2343.22 net £1866.83
May 2018 gross £2462.99 net £1920.89
June 2018 gross £2543.83 net £1962.62
July 2018 gross £2735.75 net £2088.70
Aug 2018 gross £2214.09 net £1746.36
Sep 2018 gross £3370.08 net £2504.69
Oct 2018 gross £2821.87 net £2145.02
Nov 2018 gross £2153.99 net £1707.11

Does he meet category B?

Seems category A non-salaried instead category B

Please could you elaborate further
Also do you see a problem with the £8.01 per hour?

They don't care about per hour rate rather only concern with annual gross wages.

Sorry Seagul, just to confirm - his employer has now given him a letter to say he earns £15k basic annual salary but also receives the additional monthly amount of £350.00. Is this ok to submit?

It will be category A. However anything apart of his fixed wages will be calculated by non-salaried person approach if it varies each month.
