ILR application with Appeals and EEA visa

Hi,
I have spent 6 years on student and psw visa. Then made an dependent application on my partner who is an EU national. My application was rejected first and I appealed against it and got my visa in the second application. But I was on appeal for more than 2 years. Now, when I complete 10 years. Am I still eligible to apply for ilr ??
Also, How long can I stay out of UK each year.

What date did your PSW visa expire?

Did you apply as unmarried partner of an EU citizen?
