Hi,

I have a question regarding the timelines of applying for my indefinite leave to remain on a SET (M) application.

My initial visa was granted from Morocco and valid for 33 months. I entered the UK on 20.12.13. I then applied for my FLR visa prior to that visa expiring and the expiry date is 20.02.19, I will have actually been in the UK 62 months on this date.

My question is can I apply for ILR 20 days before first entering the UK therefore after 20th November this year (but this is more than 28 days before my current visa expires) OR do I have to wait until 28 days before my current Visa expires.

The only thing the application states is that I can apply 28 days before the qualifying period but this isn't clear anywhere! Any help would be much appreciated.

FYI the reason we don't want to wait to apply until January is because we have a baby due mid Jan so would rather get the application out the way at the beginning of December if possible.

You can apply no sooner than within 28 days before the 5th anniversary of the date you entered the UK.

Thank you, how to I prove the date I entered into the UK, I don't have my old passport with the entry stamp in it. Will a plane ticket suffice?

I renewed it at the moroccan consulate in London and they didn't give me my old passport back!

If you have your ticket and boarding pass then I suppose that would have to be ok.

You should have copied your whole passport as it will also be a requirement for citizenship.

You might need to apply to HO for a subject Access Request to get ll the records they hold about you.

False alarm! I've found it! It has the initial visa and the entry stamp on it showing 20th December 2013 so I can apply after 21st November this year! Phew!

You cannot apply sooner than within 28 days before 20 December, not 30 or 29 days.
