Hello everyone,

I'm in a bit of a difficult situation and looking for some advice. So, I applied for ILR under long residence route in 2017 September, my last visa expired in September 2017, it got rejected because my total absence was 600 days, I appealed twice but it got dismissed, currently my solicitor has applied for permission to appeal in Court of Appeal. But now if I were to make a new application my current 10 year period would have less than the 540 days absence limit, my solicitor requested my passport and documents to be sent to a service centre so we can use the premium service, but Home Office hasn't replied yet, and the solicitor is worried that we wouldn't have much time left and he doesn't see my case being allowed to appeal in the Court of Appeal, the only option would be to send a postal application. The problem is I would be out of work for so long if I apply via postal application and I wouldn't be able to do anything really until I get ILR.

Is there any other options for me?

Why did you apply when your absences were over the limit and you were already advised in August last year that you can only apply if you meet the requirements and your absences are within the limit???

Thanks for your reply.

I applied because there's no other visa that I could get. And my solicitor has told me if I reapply now my absences would be within limit. The problem I have now is that the Home Office has my documents and I can't use the premium service so I have to apply by post. My solicitor tried requesting them to be sent to the service centres but there's no reply.
