ILR SET(M) Financial Requirement

Hi,

I am in the process of preparing my application for ILR as a spouse of a British partner.

My salary is well over the minimum requirement, and I am wondering if I can rely on this alone, without providing any information from my partner?

The reason being he is self employed , in the first year of business and getting the evidence together is going to be tricky.

SET (M) - ILR Application Date

Hi,

I am currently on a (Further leave to remain) Spousal Visa and nearing the end of its validity, looking to send an application in for ILR - SET(m).

can anybody clarify if there is a specific time period at which one needs to apply for the SET(M). Or is the same as further leave application - 'no earlier that 28 days before the current leave expires?'

Cant seem to find any info that clarifies this for ILR applications.

You can apply no earlier than within 28 days before reaching 60 months residence counted from the date you entered the UK OR anytime thereafter before your visa expires

i see that you can only make applications online now. I'm assuming this means that the online application should be submitted within this timeframe?

Do you know how this deals with documents required? Are these posted in separately or are they attached to the online application?

If you know of a source which has this info then please let know, I cant seem to find clear explanations of the process on gov.uk

one last question.
am i correct that:
- the date I submit the online application is registered as the application date?
- depending on availability, the date of the appointment might fall after the visa has expired- do you know if there is there a grace period that allows for this?

You must apply and submit before your visa expires.

Date of application is usually the date of appointment and submission of documents.

I see that the immigration rules state:

E-ILRP.1.3. (1) Subject to sub-paragraph (2), the applicant must, at the date of application, have completed a continuous period of either:

(a) at least 60 months in the UK with:'


this kind of contradicts the 28days prior?

Is there somewhere that clearly sets this out?

The 28 days early concession applies to ALL visa categories applying for ILR, so you can apply within 28 days before reaching 60 months as the earliest point to apply and your application will be considered as meeting the residence requirement.

So you can apply at 59 months 2/3 days or any time before the visa expires.
