Dependent over 18

Post by titi » Tue Nov 13, 2018 1:12 am

I first applied for my dependents visa in 2015. My daughter was below 18 and they refused. Apparently a solicitor was lying that she had submitted for for judicial review. I had to use Obdusman to recover my money. I finally applied for wife and 2 kids under 18 and visas granted Jan 2018. My daughter 20 at university back home is coming for Xmas on visitor visa. Is there any way I can apply for her to stay as my dependent as she still is under my care.

Thanks for your help.

No, not if she is over 18 years old. She would have to find a visa she qualifies for in her own right if she wants to come to the UK.

Why did they refuse her when she was under 18? Did she appeal?

31:
… If under 18 the applicant succeeds under the Rules. If over 18 an applicant must show (as the Appellant in this case did) that there is a strong dependency on her parents, such that the legitimate aim of immigration control would mean that the interference in the Appellant’s private and family life was disproportionate.

Hi.
At the time my wife was applying with them to join me. They refused her on basis that they had refused my wife saying our marriage was not subsistence. Which form do I use to apply for her. Thanks

How did they come to that conclusion when you have three children?

Applications from outside the UK are online now.

Unfortunately, as CR001 indicated, it may be more difficult now, since at least two years have passed.
