Switchiing from ICT Tier2 to Tier2 General-Cooling off Period

Hi

My Husband came to UK on 6th Oct 2018 on ICT Tier2 with 1 year visa. Now he got the offer from another Employer . They are ready to sponsor Tier2 General Visa.

But In most of the blogs we read there will be 12 months cooling off period employee need to serve in his own country once after return from UK .He can't switch to Tier 2 General from ICT Tier2 directly. Can some one help here is there any way he can move to new job with out cooling off period.

Few of my friends told this cooling off period only applicable if Employee exist in UK with minimum 2 years service on ICT Tier2 visa. Does any one aware this Rules. Please help here.

Your friends are wrong. The cooling off period applies regardless of how long an ICT migrant has been in the UK.

The only way to avoid cooling off is if the new sponsor offers a salary of £159,600pa or more. He would still need to apply from home country with a restricted CoS.

What is the SOC for the job the new employer is offering?

Presumably the new employer has completed the full and proper RLMT process??
