Required time for ILR : Dependant child of 10 year ILR candidate

Hi,

I have come to the UK in March 2011 (Tier2-ICT) and will be getting my ILR by March 2021 on 10 year route.
My dependants my wife will also get it as she has accompanied me throughout the tenure.

Our child was born here in the UK in Oct 2014.

1. My question is what would be my child's status once we get the ILR in March 2021.

2. Will she also get the ILR?

3. If not when will she get it?

4. Also I have heard about ILR for children who lived in the UK for about 7 years. Is there any criteria to get the ILR for children in the 7 year route?

1. Do you plan on registering the child as british?? If yes, child does not need ILR.

2. Long residence ILR does not permit dependents to apply. You would have to apply on form Set f if you don't want to register the child as british.

Hi CR001,

Thanks for the response. I should have been more clear on this.

Child has travelled back and forth to India a couple of times on an Indian passport. Would she still be able to get the Passport. If not what should we do to get her the ILR with us in 2021?

A UK born child is entitled to register as British under Section 1(3) of the nationality act when EITHER parent gets ILR.

Travelling out of UK is irrelevant for the see applications so not sure why you believe it is an issue.

Child will however likely lose Indian citizenship though.
