ILR after continuous 5 years dependent but different categories

Post by RubsArchi » Sat Jan 19, 2019 8:16 pm

Hello Everyone,

- I arrived in the UK in March 2014 after getting married to my husband who was on a Tier 2 General then. I was thus on his dependent visa as a 'Tier 2 Partner'.
- In 2016 my husband applied for ILR under the 10-year rule. I was then subsequently given a dependent visa as 'Spouse/Partner Leave to Remain'. In 2018 he went on to become a British Citizen.
- I have now completed 2.5 years on the dependent visa issued in 2016 but have also completed 5 years continuous period of stay on two different dependent visa categories.

Can I now apply for ILR based on 5 years of continuous stay as a dependent or do I need to extend by dependent visa for another 2.5 years before I can apply for ILR?
Please do advise.

No, you don't qualify for ILR yet. You cannot combine different visas to make up 5 years for ILR.
or do I need to extend by dependent visa for another 2.5 years before I can apply for ILR?
You need to extend your visa for another 2.5 years on form FLR(M). Note also that IHS fees have doubled recently.
