Tier 2 ICT main to Tier 2 General dependant

Hi,

I am currently on Tier 2 ICT Dependant and plan to move to Tier 2 General Main applicant. But I had a few questions related to my spouses’ visa:

1. Since my spouse is currently Tier 2 ICT main applicant, can he move to Tier 2 G Dependant in the UK after I get my General main applicant visa?

2. Do you know what are the fees and process to do so?

3. If I get my visa in April ‘19 and he gets his by Oct ‘19, would we both be able to apply for ILR at the same time on April ‘24 since I am the main applicant?

4. If not, and if I apply before him, will he lose his Dependant visa since I would then have an ILR?

1. Yes.

2. Currently £704 i believe, although it is clearly stated on HO s website but also depends if your SOC is shortage or non shortage I think. Ihs fees depends on how long your visa is issued for but would be £400 per year. Once you are back in the UK, simply complete the online form and proceed from there. He will need to inform his employer once he has his dependent visa.

3. No as he won't meet the 5 year residence requirements as a PBS dependent. He can apply on his own when he meets the requirements. There is no rule that you both must apply for ILR at the same time. He simply cannot apply on his own as a PBS dependent before you do but can apply after you on his own.

4. No.

Thank you CR001 for your helpful response.

I had an additional query too:
Could you please help me understand the 180 days leave in a continuous 12 month period.? Does that mean, that in a year I can be out of the country for a max 180 only and not more than that? Or at any one point of time 180 days at a stretch?

It is 180 days absence per 12 months cycle.
