Is visa extension required for PBS dependent for falling short of 1 month for ILR?

Post by lpalayil » Wed Feb 13, 2019 1:29 pm

Hello,

Apologies for the long post.I have some queries regrading the ILR appliaction situation.

My husband came to UK on tier 2 ICT visa in 2012. I joined him on depenedent visa in 2013. In 2015, I switched from Tier-2 ICT dependent to Tier 2 general main applicant. I got a 5 year Tier 2 general visa valid from 19 Jan 2015-18 Feb 2020. I had to travel to my home country to make the application and I arrived UK on my new visa on 20th Jan 2015.
My husband switched his visa from Tier 2 ICT to Tier 2 general dependent from inside UK and he got the visa validity dates as : 03 March 2015-18th Feb 2020. In 2017, I switched my employer and applied for new visa with the new cos letter. Now my tier 2 general visa is valid until 2021 although am eligible to apply for ILR in 2020. My husband did not change his visa and still has the same previous visa and validity as PBS dependent. My questions are as follows:

1. I will finish 5 years in UK on Tier 2 general visa on 20 Jan 2020. I read somewhere that application for ILR can be made 28 days before one finishes 5 years? Does that mean I can apply for ILR after 20 decemeber 2019? Can super-priority application be considered when applying 28 days before?

2. My husband will complete 5 years in UK as tier-2 dependent on 03 March 2020, but his visa validity ends on 18th Feb 2020. Does he need to apply for renewal of dependent visa to cover for one month? Can he apply for ILR after between 03feb-18th feb without renewing visa?

3. Can we both apply together for ILR in february 2020 instead of me applying first and then him?

Many Thanks.

You can apply for ILR no sooner than within 28 days before the 5th anniversary of your initial Tier 2 General visa ISSUE date.

He can apply no sooner than within 28 days before 3rd March 2020. No need to renew his visa.
