Spouse Visa extension, sole responsibility.

Hello,

Getting my wife and step sons second visa. This time from inside the UK.

They did not return the original legal documents we used to prove our sons sole responsibility the first time. So now we are in the UK after two and a half years trying to figure out he is still our sole responsibility.

He is now 19 years old, but still lives with us, goes to college and is single. So our dependant. We can prove he lives with us as we have letters spanning the years here.

However what else can we provide to prove my wife continues to be the sole responsible parent.

Frustrating we need to prove this again as we are in the UK.

I can find information about second/extension Spouse visas. And how you must prove living together.

But I have not seen anything about second/extension of dependant child visas. I will send evidence, some college letters, for our son living with us.

Also this must make a difference I think, the fact my spouse and step son are Peru nationality, but he has only lived in Chile since age of 3 and has lost his right to reside in Chile since living in UK. also he has not family in Peru.

However that sounds hard to prove.

No requirement to prove sole responsibility as he is over 18 now.

Applies same visa as your spouse and must submit evidence as you have suggested. He must not be leading an independent life for example.

Where did you see we don't need to prove sole responsibility. As I struggle to find anything about visa extension for child. Only thing as you have mentioned is over 18 must prove he is not independent.

The new online application says you must provide sole responsibility evidence still. Even though the application acknowledges he is over 18.

Not sure how you prove you are single. But we can certainly prove he lives with us as everything is addressed to us.

I will get him to write a statement, telling how he is living with us, depends on us and in education. And has never had contact or any support from his biological father.
