HELP PLEASE - Marriage in Scotland

HELP PLEASE - Marriage in Scotland

Hi All,

I have a unique situation that I can't seem to find an answer to on the UK visa/immigration website and their representative was less than helpful. My fiance and I are planing to get married in Scotland this summer. We both live in the US and are having a destination wedding. She is a US Citizen. I am a US Citizen and a UK Citizen. I have never lived in the UK before and we do not plan to stay in the UK after our wedding. I understand that my partner will require a marriage visa to get married in the UK, that seems straightforward. The tricky part is with me; Being a British citizen, do I need a marriage visa as well?

On same pages I have seen that British citizens or those who qualify for British citizenship are not eligible for this Visa. Then elsewhere I have seen it stated that those who do not live in the UK and want to get married in the UK need to have this visa. Any clarification would be greatly appreciated, Thanks in advance.

If you are a UK citizen then you wont need to apply any type of visa for yourself for entering & marrying in UK even though you never have lived there. Your other understanding is correct that your non-UK partner will need to apply marriage visa if wishes to marry in uk but then have to leave UK for applying the spouse visa from outside the UK in contrary to fiancée visa when switching to spouse visa is allowed from inside the UK. But economically its always best to marry first from outside the UK then apply for spouse visa once the sponsor is able to meet financial and accommodation requirement. Since you have no intention to move to the UK after marriage, a marriage visitor visa would be appropriate:

There is a rule that a marriage involving a non-EEA partner has to be registered at a Home Office designated register office and the notice period can be extended to 70 days. I am not sure how this would apply to a destination wedding involving a non-resident UK and a non-EEA citizen. Maybe somebody else on here can clarify.

My understanding is that the necessary Home Office checks are made when assessing the Marriage Visitor visa application. :idea:
