Implications For Tier 1 Ent Dependent

Post by intrusive » Fri Mar 22, 2019 3:29 am

Hello there forum members, i have recently got my extension approved. I got my visa until March 2021 I have my dependent wife and child who are in Pakistan. I am planning to bring them here in UK before applying my ILR application because once i get my ILR it would be require a lot more documentation and I have to meet lots of Financial requirements. I will complete my 10 years on February 2020 next year. And By end of January 2020 i will apply for my ILR.
My Question is if i call them here now and before applying for my ILR do they need to switch their visas as well? or can they stay on their normal dependent visas until March 2021 .
If they need to change their visas what will be its implications please? Do i need to meet the financial requirement of £22400 per annum?
Is there any other implications of changing my visa on their visa.
Please moderators and senior members help and guide me.
Thanks.

If you apply for ILR based on long residence, they will have to switch to spouse settlement visa on form FLR M once you get ILR or before their visa expire. If they want to travel out of the UK, they should switch before travelling.

You will have to meet the financial requirement yes and your spouse will need to meet the English requirement.

Thank you CR001 just to clarify does that means they can stay on their visa until expiry if they are not going out of UK and on expiry of their leave they have to Switch their on form FLR M.
And one more question please when they will be eligible for ILR? My Daughter is only 2 year old.

Yes, that is correct. But remember that the 5 year clock for ILR restarts when they change the visa. So if you only change in 2021, ILR eligibility will be in 2026
