ILR SET M - Please help

Post by D311 » Mon Mar 25, 2019 6:46 pm

Hi all,

I have been a silent reader so far and thanks to you all I learnt a lot of things.

I just ant to check few things with you that I am worrying about.

My immigration history as follows.

1. 4th of October 2010 arrived UK - student visa valid until 30th January 2012
2. 13th of January 2012 applied student visa extension by my college behalf of me by post but returned invalid as HO couldn't charge the money from the bank
3. 7th of February 2012 college applied again by post but refused on the18th April 2018 saying I have insufficient funds. (when I applied it was old rules and only £1300 needed but seem like they took my application under new rules after April 2012 and the funds were increased)I had to wait until May/ June 2012 to apply again as I had to keep the bank for 28 days. I kept contact with the HO by letters and by calls about the application. By this time I had my fiance and my family and friends help immensely with all the help I needed.
4. Visa granted on the 28th of August (until 28th of August 2013) almost after 7 months .
5. Applied for another student visa extension. Visa granted on the 2nd of September 2013 (until 28th of December)
6. I got married to my fiance who is British citizen a month later and on the 7th of May 2014 we applied for FLR M visa and granted (until 7th of November 2016)on the same day as we went to the premium service.
7.Applied for FLR M extension October 2016 and granted this visa until 7th of May 2019.

My worries are,

1. Do you think I have to worry about the period of Jan 2012 - Aug 2012 because HO couldn't get the payment and etc I had to become an over stayer? Is this likely to be a result of a refusal? :?

2.Am I eligible for submit my application on the 10th of April for ILR SET M under 28 days rule?

3. Document check list - Are these enough?
- Applicants and Sponsors passport
- Applicants BRP
- Sponsor's 6 months payslips, 6 months bank statements an his employers letter confirming his salary.
- Life in the UK
- B1 certificate
- Marriage certificate
- Correspondent letters
- Land registry for accommodation in both our names

Thanks in advance

1. The overstay should not have an effect on ILR based on 5 years FLR(M). It could however affect an application for British citizenship.

2. You are eligible to apply within 28 days before the 5th anniversary of the date of issue of your initial spouse visa.

3. Should be fine.

First of all thanks for this amazing forum and all board members specially CR001 for all the help I received.
Apologies if I have posted this in the wrong thread.

I have granted ILR SET M today. :D I am over the moon...

My appointment at Croydon was at 9.00am today. I scanned all the documents beforehand and uploaded. The lady took the biometric and checked the documents and confirmed all in order. She said it usually take 24 working hours to receive a decision so if I didn't hear from them today I will hear from HO on Monday. (I thought I have to carry this burden until Monday even after I paid for super priority service + £100 appointment fee :x ) Just after 11.00am I received an automated email saying the process might take up to 6 months. A minute later I received another email saying my visa has granted.

We used my husbands salary for my application even though i am working full time . Also I did my Life In The UK test back in 2014 and it was all fine. However I did B1 English test recently as I didn't want to take any risks. (I used IELTS certificate- Academic for my previous applications.)

A huge thanks to all the members and board members. I have learnt a lot by reading the posts.

I hope you all help me with my BC application too as I think it will be complicated because I was an overstayer in 2012.

Thanks again
