Latest date to submit ILR Set M application online

Hopefully a very straightforward question - I tried to search for an answer but to no avail. My wife’s FLR visa expires on 2nd May 2019. We’ve been a bit slack with our ILR (set m) preparations due to having a new baby, so my wife hasn’t taken the Life in the UK test yet. The ILR application itself seems straight forward and has been completed online- we are just waiting for my wife to take the test (and pass it!) before pushing the “submit application” button.

My question is this. When is the latest we can submit our online application? Can we do this on, say, 1st May?

In reality we will submit once the test is done, but I just want to know what the absolute deadline is.

She can apply no sooner than within 28 days before reaching the 5th anniversary of her date of entry to the UK on a spouse visa.

Applying too early could result in a refusal and being put on a further leave to remain route (possible 10 year route).

You must only submit once she is within the 28 days qualifying period OR before her current visa expires.

Note that she also needs to meet the B1 English requirement if not from an exempt country.

Thanks. Yes, we have factored in the 28 day rule. We’re different to most in this forum in that we would prefer to apply as late as possible.

So just to confirm, if we submit online on 1st May (the day before the visa expires) and go to the visa centre (super priority) a week later (after the visa expires), is that ok?

The English requirement is ok as my wife did a recognised degree here.

Thanks. Yes, we have factored in the 28 day rule. We’re different to most in this forum in that we would prefer to apply as late as possible.
