Tier 2 ICT to General dependant switch queries

Post by mosty_anonymous » Tue Jun 04, 2019 8:14 am

Hi,

This is going to be a long one, but urgent please. So any help aapprecited.
I am currently working on Tier-2 ICT and my wife is on dependant visa.
She got a job sponsorship and is now ready to apply for General visa, and I would like to switch to being her dependant.
We will be leaving the UK for her visa application, which will be filed with priority mode.

1. Is it possible that we apply together in home country? (From what I've read online till now, the answer is yes. Assuming that,) is it possible that the dependant visa can also be applied in priority mode? And will we get the visas at the same time?

2. Given that my current ICT visa / BRP card will be invalidated (I presume), do I have to notify the company I work for, beforehand? Or at what latest point of time can I notify them?

3. Once we get our visas, there shouldn't be any issues with me entering the UK again to go back to work? Given that I won't have my BRP card for some time until it is printed and collected.

4. Considering a possibility that our application is rejected, will my current ICT visa / BRP card be restored and returned to me in time, or will I lose my current work position altogether?

Any guidance highly appreciated with this.
Thanks.

1. Yes you can apply together. You can also wait for her to return and switch to dependent visa within the uk.

2. You need to notify them once you have a new visa and provide proof of right to work.

3. You will have a 30 days visa vignette in your passport to enter the UK.

4. Your ICT visa is only cancelled if you are granted another visa. If dependent visa is refused, your ICT is not affected.

Thanks a lot for the quick response! That was really helpful.
We will apply together from the home-country in priority modes.

I have been living in the UK for more than a year working in IT.
Do I as now a dependant still need any reference letter from my wife's (main applicant's) sponsoring company?

Can I please be pointed to the list of documents required for main applicant and dependant Tier 2 General visa applications?
Thanks.

No and not sure why you think you do. Your wife's sponsor has nothing to do with your empyment

The online form and the tier 2 guidance notes tell you what is required.

Thank you.

Also, after we both get our visas (she gets her Tier 2 General visa and I get the dependant visa), can I travel back to UK first while she travels back a week later?
Is it okay if we specify different flyback-to-UK dates in the application where mine is earlier than hers?
