Post ID return time? Eu Exit app fails to scan ILR BRP

Post by ariskar » Wed Jun 26, 2019 4:41 pm

The EU Exit app failed to scan my wife's ILR BRP obtained in a non-EU settlement route... (to swap this with settled EU status). The app claims the non-EU spouse ILR BRP (issued 2019) is a "wrong" document.

From our forum members experience, how long does it take for the return of ID documents in the EU Settlement applications?

Why exactly do you want to apply for the settled scheme when she has already been granted ILR under the protection route?? They are both the same end result.

She also won't get settled status, she will get pre-settled status as she has not been married to you for 5 years. In all of your numerous topics where you have asked many duplicate questions and scenarios, you have received answers.

We applied and sending the ILR BRP by post.

Reasons:
(1) > 5 vs 2 years of being out of country before it lapses.
(2) >>New convention travel document takes 2-3 months based on recent experience. Settled status should be quicker and she could then try to obtain a home country passport (usually 1 week) without caring of refugee (settled) travel restrictions on home country passport. (does not intend to travel to own country). Applying for naturalisation to British passport takes 3-4 months too. This way she could be able to have documentation to travel internationally and fear no status loss (as per settlement refugee). (biggest advantage)
(3) > Free application, nothing to lose.
(4) > Your proof of immigration status does not mention refugee route, hence avoid possible discrimination by employers, landlords etc.
(5) > She applied online and sent the ILR BRP. The online application said she would only be considered for settled status based on residence records (has been in the UK for 7 continous years, HMRC/NiNo checks out). This was the automated system response.

I will keep the forum updated with our EU settlement application experience.

All I asked in this post is how long it takes to get ID documents sent by post to EU Settlement team of Home Office, based on members' experience... I didn't seek advice/opinions on if we should apply.

We posted ours with a pre-paid special delivery return envelope.

My wife holds ILR under UK immigration rules

If you would like to apply for SETTLED STATUS ( under eu settlement ) you need to be married to an EU national for 5 years on the date of the application if married in the UK
UK Student Visa : 04/2004 - 09/2009
EEA Residence Card : 07/2010 - 7/2015
EU Settled Status: Confirmed on 16th July 2019
Naturalisation : Confirmed on 02nd Oct 2020
Passport Approval : 21st Feb 2021

The worst thing that can happen is that settled status is rejected and ILR status remains. The application was free of charge anyway. The application said my wife is considered only for "settled status", this is what the application said in the automated determination. She has lived in the UK for 7 continuous years and she already holds ILR. Lets wait and see how this goes. Home Office are unhappy to reject EU Settlement applications as this ruins their almost 100% acceptance rate tolerance PR before Brexit arrangements are concluded. My wife has ILR, so pre-settled status is not an option of grant, thus the only answers are "settled status" or "rejected". If what you and CR001 mention is a firm requirement indeed, (which also applies to those already settled/ILR through other routes :!: ) there could be either rejection or a discretion grant.

"The application said my wife is considered only for "settled status"

Because your wife included national insurance number. In your case Case Worker will call / email you that sorry we can only issue your pre settled status. They said this to many people on this forum . So Pre - Settled yes . Settled Status NO

Lets see, it will be interesting. On a similar note, it is not possible to issue pre-settled status to someone who is already settled through a different route (ILR).
