Tier 2 General ILR

Post by tugrulguclu » Thu Jun 27, 2019 4:26 pm

Hi everyone
Hope this is the right place for my questions.

Route:Tier2 Sponsored General with 5 year visa (still the same employer)
Main applicant (me) :Visa valid from 22/02/2015 to 09/03/2020
Dependant1 (spouse): Visa valid from 22/02/2015 to 09/03/2020
Dependant2 (born outside UK son): BRP issue date:17/08/2016 valid until 09/03/2020
Just want to confirm

(1) I can apply 28 days before from 22/02/2020 ?
(2) my dependants can apply with me in the same form ?
(3) Each of us have to pay current fee (2389£) ?
(4) my wife has 7 months of continuous absence between 12/2015 - 07/2016 due to pregnancy but as far as I`m concerned this is a not problem because dependents are not subject to 180 days absence before 11/Jan/2018 ?
(5) My wife and I have taken IETLS academic on 22 November 2014 when we apply of Tier2. Overall results are 6.0 and 7.5 respectively. This https://www.gov.uk/english-language/app ... ifications tells that
You can use a B1 level qualification that’s run out if both of the following are true:

it’s on the current list of recognised tests
it was accepted for another UK immigration application, for example when you got permission to enter
Do you think we need to take that again ?

(6)if we get the ILR next year we`ll apply for British citisenship. Do you think is it possible if my son applies to citizenship without applying ILR ?

I would really appreciate if you could help me to clarify some of these.
Thanks in advance

1. Yes.

2. Yes.

3. Yes.

4. No issue as PBS Dependents who have visas issued BEFORE 11th January 2018 have NO absence limit.

5. You need IELTS B1 for ILR. Especially your spouse as your spouse did NOT need English for a Tier 2 dependent visa so if it was submitted if would have been disregarded completely.

6. No. A child born abroad will qualify for citizenship once they hold ILR and when either parent is also applying and the other parent holds ILR.
