PBS visa to ILR-Absence query

Dear All,

I am UK Citizen. My spouse is in PBS Dependant visa. She entered into UK in this visa on December 2014.
She was outside UK more than 5 months.

1. Can you please share the absence period limit for ILR through PBS dependant 5 years route?

When (dates) was she absent??

What date was her most recent visa issued??

Thanks for your response.

1) The PBS visa issued on Dec 2014. I applied for extension on may 2018 and its valid till May 2021.
2) She was absent on following days
30 September 2015 to 20 Jan 2016
10 Feb 2018 to 1 Mar 2018
5 Aug 2018 to 24 Aug 2018

Only absences from May 2018 onwards (visa issued under new rules) count towards the 180 days per residence year limit.
There will be no limit for absences before May 2018 (time spent with visa issued under old rules)

Thanks for your response.

I hope the 5 years calculation start from date of first entry under PBS Dependent visa that is Dec 2014 and she qualifies for ILR in Dec 2019. Am I right?


Is my assumption below right based on your response please?

May 2018 to MAy 2019 - 180 days absence allowed
May 2019 to May 2020- 180 days absence allowed

PBS Dependant visa to ILR

I am holding UK Citizenship through Tier 2 ICT 5 Years route. My spouse and child (India born) are in PBS Dependant visa valid till Dec 2020. PBS dependant Visa issued on 1st Nov 2014 and landed in UK on 1st Dec 2014. I assume they are eligible to apply ILR by 3 Oct 2019. Can you please help with the below queries?

1. List of documents required to apply ILR for my wife and child?
2. My Wife is working since 2 years as a contractor and having limited company. Do we need to prepare any additional documents in this scenario?
3.Is there any benefit in ILR process because I am holding citizenship? I heard dependant can get citizenship without 12 months waiting time if main applicant is holding a citizenship.
4. What are the options available for applying ILR in this scenario? ex: Postal service or same day appointment

Passports, BRP, 2 years evidence of cohabitation in both your names from 3-6 different sources. English B1 and LIUK.

No.

No benefit no. Both applicants must meet the requirements for ILR. Yes your dependents do not have to wait 12 months on ILR to apply for citizenship, provided your spouse meets the 3 years residence requirements.
4. What are the options available for applying ILR in this scenario? ex: Postal service or same day appointment
Super priority @ £800 extra each or standard service which takes about 8 weeks.

1. Regarding the documents required list , don't I need to show the bank statements to prove the minimum living cost? Also can you share the link for application form?

2. As you mentioned below, they don't need to wait for 12 months for naturalisation. Can they apply ILR and naturalisation together ? Will it save any cost?

3. I understand I need to provide only my child passport and BRP card. Do I need to provide anyother documents ? like birth certificate etcs.,


4. Can you share the link for booking an appointment for ILR please?

1. No. You need to send what the checklist asks for.

2. No they cannot apply for both together. They require ILR and the BRP card BEFORE they can apply for citizenship. There is no 'cost saving'. Each applicant must pay the fee for each process and application. There is also no fast track or super priority service for citizenship.

3. Please follow what the checklists will tell you is required.

4. You book the appointment as part of the online application process at the end. You cannot book an appointment before applying online.

One form, wife as main applicant, child as dependent.

You can apply separately later for your child yes, expect HO to ask why the child has not been included with wifes' application. No, there is NO cost benefit or family discount. Each applicant must pay the fee.

You do NOT submit originals, you scan and upload the documents before your UKCVAS Sopra Steria biometrics appointment. No you cannot travel out of the UK while the application is pending even though you will have their original documents. Leaving the UK will cause their ILR application to be withdrawn and you lose the fee.
4. Regarding cohabitation documents , can I submit all the documents only on my name for 2 years? I may not have many documents on my wife name.
No. You must submit documents in either joint name with your spouse or addressed to each of you individually at the same address. That is the whole point of proving subsisting relationship and cohabitation.

1.What are the sources are accepted ?

2. how many letters or how frequent letters should be submitted?

3. Can you please confirm Do I need to submit 2 years or 5 years cohabitation proof?

4. Is the below documents sufficient for cohabitation proof?

Example Documents on my wife name along with dates.

A. BANK Letter Sep 2017
B. Governament Gateway July 2018
C. HMRC letter July 2018 , Aug 2018,April 2019, Jun 2019
D. Poll Card May 2019
E. NHS Letter NOV 2017, DEC 2018
F. Home office letters

Documents on both of our names.

A. Council letter April 2017,May 2018, Mar 2019

Documents on my name.

A. Bank statements
B. Poll Card May 2019

Dear Team,

Regarding English requirement for ILR application, my spouse completed degree in India. I found either she has to go through any one of the below option

Option 1:
your degree certificate
confirmation from UK NARIC that the qualification is to the same standard as a UK degree or above
confirmation from UK NARIC that the degree was taught in English

Option 2:
B1 SELT – GESE Grade 5.

Can you please let me know the price for getting UK NARIC confirmation in option 1?

About £150 for the ukvi naric red route, same price as the English test.

Dear Team,

I am holding UK Citizenship through Tier 2 ICT 5 Years route. My spouse and child (India born) are in PBS Dependant visa. I am applying ILR application for my spouse and child. Can you help me with the below query please?

1) My child Indian passport was lost which had the initial Dependant visa stamping (2014). I applied a new passport and received it. Now I found my child old passport as well which was lost earlier.
In the above scenario, Do I need to submit only the new passport for ILR application or both the passport?

Regarding Tax Free childcare account, Yes I am only claiming this. However to eligible for Tax Free childcare account both the parent should be working so I provided my spouse details as well.

I am using this Tax free childcare account since 1 year. Will it impact my Spouse ILR ? Do I need to provide this details in her ILR application please?
