Tier 2 - Redundancy - Notice - Travel - P45

Post by Ahmed285 » Wed Jul 24, 2019 8:46 pm

Dear all,

i will try to make a brief of the situation and the question:-

1. I'm under Tier 2 Status valid til December 2021.
2. I started work for my employed on December 2019.
3. I lost my job and put to redundancy on 3 June 2019 because the company is dissolved.
4. According to the redundancy letter, it says that me last day of work was 3 June 2019.
5. In addition to previous point i am entitled to 3 month statutory notice pay.
6. Before the redundancy i had already arranged for summer holiday from 19 August to 31 August 2019.
7. I have not received any visa curtailment letter from the Home Office.
8. I have received my P45 certificate stating that my last date of work was 3 June 2019.
9. My contract states that i should have 3 month notice if either of the parties want to terminate it, but yet still my P45 certificate states that the last date of work says that the last day of work is 3 June 2019.

So, One qusetion is, can i travel outsidethe UK from 19 Aug. 2019 till 31 Aug. 2019 and come back with no problems with immigration desk considering that i'm serving my notice period "not neglecting the fact that i'm now redundant and i have received the P45 Certificate" ??!! (before answring to this question please check carfully points above)

One more question, do i understand it correctly if i say that the 60 days "Home Office Grace Period" starts on 3 September 2019, considering 3 month notice from 3 June 2019, but also what does it mean receiving the P45 Certificate stating that the last day of work was 3 June 2019 then??!!

Situation seems more complicated, as i have me and my family have just shifted our whole life to the UK, so i would really appreciate professional advice.

Thank you in advance

Have you been paid out 3 months notice salary as part of your redundancy package?

Your employment ended on 3rd of June and a P45 issued. Your sponsor would have notified HO already.

It is risky to travel out of the UK as you could be refused entry as your circumstances have changed and you are no longer a sponsored worker. If you are refused, you will be subject to the 12 month cooling off period before you can come back on a tier 2.

60 days curtailment period (not a grace period) starts when HO sends the curtailment letter or if you are outside the UK, often instantly and visa is cancelled.

You would do better to forget about your holiday and try to find another job and sponsor and apply for a new visa.
