Do I have to wait for my husband to get his ILR first before I can apply to extend my Tier 2 dependant visa?

Hello,

My husband is American. He is due to apply for his ILR before his visa expires. His Tier 2 General visa period is 28/10/2014-28/11/2019.

I am currently on Tier 2 dependant visa (BRP) 27/06/2016-28/11/2019. My visa will expire on the same day as my husband's, so I will have to apply for an extension (as I am not qualified for ILR yet).

My questions are as follows:
1. Is there a way for us to submit our applications simultaneously, his ILR and my extension at the same time? Will they be able to link our applications together? Which forms should we use?
2. If not, do I have to wait for my husband to get his ILR first before applying for my extension? Does this mean he will have to pay 800 pounds for the super priority service, so that he will get his ILR in time before my visa expire, so I can submit my extension in time?

1. Yes, on the two respective forms. However your application will not be processed until his ilr is granted. If his ilr fails, your extension application will also fail.

2. Your choice if he chooses to use the super priority, which is not guaranteed to be a quick decision either. If you choose the 8 week standard service, it takes up to 8 weeks, sometimes longer.

He can apply for ilr no sooner than within 28 days before the 5th anniversary of his initial visa issue date. He doesn't have to wait till 28 days before visa expiry
