ILR Long Residence - Dependent Help

Post by sshah_2019 » Mon Aug 19, 2019 2:26 pm

Dear Sir/Madam,

I will be completing 10 year lawful residence in UK (Tier 4 Visa + Doctor Extension Scheme + Tier 2 General (valid till Nov 2021)) on 20th September 2019.

My wife has joined me as PBS dependent on 2nd March 2015 and have PBS Dependent Visa till 2021.

Please can you help with my question

If I apply for ILR now using 10 year long residency. Do my wife need to switch to FLR M or can she still apply for ILR on its own as her visa will expire in Nov 2021?

Should I wait for 5 year PBS to apply with my wife?

Thanks

Yes she has to switch to FLR(M), which resets her 5 year clock for ILR. She cannot apply for ILR as a PBS Dependent if you have not applied for ILR via the PBS route. She also cannot remain as a PBS Dependent.

Your choice if you don't want to delay your wife's ILR.
