Tier 2 dependents applying after main applicant gets ILR

Post by Mavynne24 » Sat Aug 31, 2019 10:40 am

Hi. I have been here in the UK for 5 yrs on November of this year and will be applying for ILR (via priority service) while my husband and 2 sons will need to extend their visas because they will be completing their 5yrs requirement next year in August. I have some questions, kindly help us.

1. If we lodge their application after my ILR is released, under what category do we do it? via the normal Tier 2 dependent extension? or is there another way to do it?

2. When we are trying to calculate the healthcare surcharge that they are going to pay, It is asking for expiration of main applicant's visa. If I get the ILR, there is no expiration date on that right?

3. On the topic of maintenance funds needed for tier 2 dependents, is it okay that the funds (which are £630 for each one of them) are in my account?

I appreciate in advance whatever insight to our predicament you can give.

1. Tier 2 dependent extension yes. It will be a 3 year extsnion. Only other route is FLR m which will reset their ilr clock to zero and a new 5 year residence period.

2. You put your ilr expiry date as 3 years from when they apply, ie X September 2022. Your ilr brp card will have an expiry date of December 2024. It is the card that expires not the status. IHS for them is £1200 each.

3. Either of your bank accounts.

Oh Thank you very much for your reply. Because I have been saving their required funds on my account then I suddenly realised that I should have transferred it to my husbands account. And if I do it now its less than 3 months already to the date we apply. Thank you.

Healthcare Surcharge, Can it be paid for less than 3years?

Post by Mavynne24 » Thu Sep 12, 2019 6:21 am

Hi. My dependents' tier 2 visas need extending and I will apply for ILR in November this year (priority service because visa will end on the end of November). When I get my ILR, thats the time we will file for their extension. During that time, they will be less than a year short of applying for ILR themselves. My question is, Is it possible to just pay for only 1 year of Healthcare surcharge as that is all they will need before getting an ILR for themselves? Your help is greatly appreciated.

No it is not possible. The immigration rule clearly state that a PBS dependent extension will be for 3 years if the main PBS migrant has ilr. You cannot choose a lesser time.
