My partner is on a Tier 2 work visa. He was arrested for drink driving in January 2019. He got 12month license disqualification (9months with course) and a £600 fine. He needs to apply for an extension visa as his visa expires soon. His son have indefinite leave to enter visa and I have a British passport. How long do we have to wait before we can apply for his extension and do we need a new COS if his initial COS was valid for 5 years and 14days but we only paid for a 3 year work tier 2 visa.

If the original CoS was specifically dated for 5 years, he should have got a 5 year visa and if there was an error, he should have had it corrected when he noticed.

How much IHS and visa fee did he pay?

Did the sponsor perhaps put a note on the SMS system to shorten the length of the CoS?

Is the son your child too?

Why didn't your partner apply for a partner visa under Appendix FM?
