separation - dependent Tier 2

Post by meghanjones » Sun Nov 17, 2019 8:00 pm

Dear all,
I hope you are all fine. Can you please help me with the following situation.
I have been living in England for about 3 years, and I have a dependent visa from my husband who has a Tier 2 visa.
We lived together for 2 years, however we separated for 1 year.
1. Apparently my ex husband has changed employer. My biometric card states that my visa is valid until January 2021. I would like to know whether the fact that he changed his job affects my visa. Would my visa be automatically canceled with his job change, or would I have a deadline to adjust my situation?
2. I have been employed for 1 and a half year, and by January 2021 my resident permit will expire. Do I have a right to stay in the UK on another visa, disengaging from my ex husband?
3. Is there any way to find out whether my visa has been cancelled?
4. Can I travel and then return to the UK freely?

Many thanks

Him changing jobs does not affect your dependent visa, however your bigger issue as that if you are no longer in a subsisting relationship which is what your visa is wholly dependent on and HO needs to be informed and your visa will be curtailed.
2. I have been employed for 1 and a half year, and by January 2021 my resident permit will expire. Do I have a right to stay in the UK on another visa, disengaging from my ex husband?
You would have to find a visa you qualifying, sooner rather than later.
3. Is there any way to find out whether my visa has been cancelled?
HO would write to you and if you no longer live at the address HO have for you, then you might not know if your visa has been curtailed. The link below is the right to work check link.

4. Can I travel and then return to the UK freely?
Risky as you could be refused entry if HO have been notified of the relationship breakdown.
