Query regarding son naturalisation

Hello All,

Me & my wife has recently got an ILR via T2. Our son was born in the UK and now eligible to apply for the naturalisation / citizenship (via MN1).

Last year, I applied for the T2 dependant visa for my son as we went out for holiday abroad (outside the UK) and the visa will now expiry in the next few weeks.

Do I need to apply the naturalisation / citizenship for my son before the expiry date of visa or it doesn't matter since he was born in the UK?

You need to apply for his registration (MN1) before his visa expires.
My advice is based on personal research/experience, so pls check relevant UKVI sources.

Not true. A UK Born child does not need a valid visa or even a passport to register as British as it is an entitlement to register.

Ah, so they can apply for MN1 even after visa expiry. Thanks for correcting.

What happens if they go out of UK and re-enter (e.g. holiday) ? Can the child re-enter UK on the basis of UK birth certificate and parent's ILR status? Or do they need to register before going out of UK?

They cannot re-enter if they are a) not a British passport holder or b) don't have a valid visa.

A UK birth cert doesn't make a child British. A uk birth cert and parents ilr won't even get them on a plane to come back.

Brilliant, thanks for the swift response guys!!

Since the visa expiry date has no effect on my son immigration status in the UK, I wouldn't apply for the naturalisation / citizenship until we plan another holiday abroad :D :)

Note that registering the child as British can take several months.

Note also that if you leave the child with no visa status for extended periods, you will likely have to pay 150% of NHS cost and use.
