What Type of Visa is Required

Post by Kobbyson » Fri Mar 06, 2020 3:55 pm

Hello Everyone,
This may sound basic but very confusing to me. I will be happy if someone can help advice me here. My partner is a British citizen who live and work in the UK whilst i work in the Czech republic(Long term Residence).I currently hold a UK standard visitor visa which enables me to visit my partner up till 180 days. We intend getting married in the UK and stay there after. we have given notice of Marriage to the council (In the UK) but since i dont live in the UK we have to wait till Max. 70 days before getting married. By the end of the 70 days my standard visitor visa will be expired and i will need a new visa for the marriage and again we want to stay after the marriage. What visa is best to apply to enable me to be around for the wedding and also stay thereafter. Also what time is best to apply - after the 70 days or anytime ??
Thank you and your advice will be appreciated.

Fiance visa. Current cost is £1523 and you must meet the English and financial requirements. This is a 6 month visa to enable you to marry in the UK and then switch to a spouse visa. This is the visa you actually need to give notice to marry, not a visitor visa that you have.

You must leave the UK before your visitor visa expires.

Yes.
if it was , what can i do since the documents is already under processing?

You will simply have to wait now but you must leave the UK before your visa expires.
and when can i apply for the fiance visa?
At anytime and you must apply from outside the UK.

Thank you once again - Yes am not in the UK, i went there for the purposes of visiting my partner a couple of times and also giving the notice. My confusion still lies on this explaination on the website https://www.gov.uk/uk-family-visa/partner-spouse
Apply as a partner or spouse
To apply as a partner, you and your partner both need to be 18 or over.

Your partner must also either:

be a British citizen
have settled in the UK - for example, they have indefinite leave to remain, settled status or proof of permanent residence
have refugee status or humanitarian protection in the UK
You and your partner must intend to live together permanently in the UK after you apply.

What you’ll need to prove
You must be able to prove one of the following:

you’re in a civil partnership or marriage that’s recognised in the UK
you’ve been living together in a relationship for at least 2 years when you apply
you are a fiancé, fiancée or proposed civil partner and will marry or enter into a civil partnership in the UK within 6 months of arriving
And this is what i feel applies to me - am really confuse why fiancé visa is required first and why i cant apply directly as a partner based on this information.
Thank you and am sorry my confusion is getting intensified

A fiance visa is required to follow the correct process to marry in the UK and swtich to a spouse visa.

A normal visitor visa is not. You cannot switch to a spouse visa within the UK as a visitor visa holder. You must leave the UK before your current visa expires. If you do not, you will be an overstayer.
