CoS nearing expiry

Post by ryan1224 » Thu Jun 04, 2020 6:29 am

Hi,
The CoS was issued and assigned to me by my employer on 15th March and it is expected to get expired in next few days which is 15th of June.

Since VFS is closed in my country at the moment we are not able to proceed with my visa application and it is expected to resume operations from July onwards.

What do you suggest we should do in this case? Should we request a new CoS? If yes, how easy and time does it take to issue a new one? Do you suggest we simply proceed with the visa application right now and pay all the fees related to it and wait for VFS to open for biometric?

Please suggest.

Heya, I also have a COS from March. If it helps, my lawyer says you get 3 months to make the visa application from the date you assign the COS (e.g. if you assign on the 15th June, your deadline to make a visa application is 15th September). I would go ahead with it and hope you can make the application within 3 months. The risk here is money: not sure if you or your employer is paying the cost, but there is a fee that is paid once you assign the COS, then the rest is paid on application; if in the end you can't make the application (e.g. centres are not open, second wave etc.) then I doubt you'd you get the initial payment for the COS refunded..

Best of luck!

Your post doesn't state if you have applied online yet?? You must apply online before the cos expires. Date of application is the date you submit and pay online and not the VFS appointment date.

Thanks for your reply. So do you suggest we simply proceed with the visa application right now and pay all the fees related to it and wait for VFS to open for biometric or request new CoS as VFS will only open in July.

Thank you.
One last question - how will it impact my Work start date and end date.

As per my CoS:-
Start date: 01 May 2020
End date: 30 April 2023

Will this needs to be changed in CoS before applying for visa?

Discuss with the employer sponsoring the visa. I am a little baffled why you are not speaking to them about your options, rather than us.
I do not give immigration advice. I refer you to Immigration Rules, guidance, other online content and to your sponsor.

The reason why I'm asking here is because my employer is a very small start-up and has no experience in sponsoring people as I'm believe I'm the first one to be hired on Tier-2 for them. My employer also does not have any immigration expert to guide them and hence they are trying to figure out by themselves in this uncertain situation. Hope now you know why I'm here.
Appreciate a straight forward suggestion on this from anyone on this forum. Thanks.

As a Tier 2 sponsor your employer has free access to the Sponsor Helpdesk to guide them through sponsorship issues. There is no reason they need to figure everything out by themselves nor do they need to hire an immigration expert.

I would be surprised if they don't know about the Sponsor Helpdesk, but you can refer them to this information:

Hi ryan1224,

My COS was expired as well while I have a valid application. What I suggest you, if your sponsor manually add a sponsor note about your start date (can be updated manually), that should be enough.
However, they can also request to extend your RCOS in which case you haven't submitted your application yet.

As an aside, if you're unemployed as per the following guidance, you can start work. Yet, I haven't been able to confirm this with someone from Home Office.
