British Passport for my baby

Post by Noel Rodrigues » Mon Jul 20, 2020 2:49 pm

Hi Guys,

Please can you help me , I want to apply for British Passport for my new born baby but i have some questions which keep confusing me.

My baby is born on 31/03/2020 and I complete 5 years in UK on 07/04/2020, both me and my wife are Portuguese Passport holders, Can my baby get a British passport since she was born here. I am just few days away from completing 5 years as i entered UK on 07/04/2015.

Can I apply for my baby British Passport after I get the EU settled status?

If not, then when can I apply and do I have to do my EEA (PR) for this?

Please can someone advice me. I will be very grateful for your help.

Many Thanks

Noel Rodrigues.

If your child was born BEFORE you attained PR based on 5 years of exercising treaty rights, then your child is not automatically British and cannot apply directly for a British passport.

You have to register the child as British on form MN1 first (costs (£1022). Once the child is registered as British, only then can you apply for a British passport.

You will need evidence of PR or Settled Status in order to register the child as British.

Thank you for your help.

If the child has a British Birth certificate, does it help?

Can i use EU settled Status scheme to prove my 5 years for the MN1.

Thanks in a million once again.

It still doesn't make the child British or entitled to a British passport.. You would need to submit the birth certificate with the form MN1 Registration as British application.
