Tier 2(General) Extension Visa Application refused

Hi,

I applied for my Tier 2 visa extension on the 5th of August 2020 but unfortunately was refused after I received an email from the UKVI NHS Team on the 24th of August 2020 stating that I do not meet the criteria. Initially I thought it was a mistake and after I consulted the caseworking team , they confirmed that I selected “Yes” for the question on my application, "Has your sponsor or employer confirmed you are eligible for the Health and Care visa?”. This was a mistake from my end where I should have selected "No".

I am now making a new application and there are a few questions before I submit my new application.

Will I be able to use the same CoS reference number issued by my employer?

Will I need to pay the IHS again for the new application?

My current visa expires on the 24th of September 2020, therefore if I submit my application prior to this date, will this affect my eligibility to continue to work in the UK?

You need a new CoS.
Will I need to pay the IHS again for the new application?
Yes. The other IHS you paid will be refunded.

Only if you apply online and submit/pay before your visa expires.

I made a same mistake. I submitted my application to extend my Tier 2 on 19th August, and my current Tier 2 visa expired on 14th October. I received an emails from UKVI NHS team informing me that I ticked the wrong box and my application is invalid and asked me to resubmit.

My concern is, since my current Tier 2 visa is expired, am I still protected by Section 3C? My employer seems quite chilled about this, and they are issuing me a new CoS for applying new visa. But if I made a fresh application, am I still protected by Section 3C? ? I am very worried about overstaying, which is a criminal offence.
Please help!!
