my name is xxxx recently my wife got tier4 visa and i applied for tier4 dependent but they refused my application
before i am in uk for 7 yeras in that between 2 0r 3 yaers i'm overstay,and i left the country voulantery they said i could face may be ban upto 11 months ,now i'm in india and ban time is over
The Decision:
You have applied for leave to enter the UK as the Tier 4 dependent of xxxxxxx . You have provided a copy of a marriage certificate which shows your marriage took place on 17/03/2019 and it was registered on 20/11/2019. You have also provided 4 photographs of you and your wife at which appears to be your marriage ceremony. However, you have not provided anything else which would satisfactorily confirm that your marriage is subsisting. Your wife’s address is noted as being xxxxxxxxxxxxx.which is the same as the address you have declared. However, the other documents provided with her visa application do not demonstrate that yours is a genuine and subsisting marriage. In addition to this, your wife declared in her visa application that her husband would not be travelling with her to the UK. This does not satisfy me that your marriage is subsisting. I am not therefore satisfied that you meet the requirements of paragraph 319 (d) of the Immigration Rules.

You have 28 days from the date on which you received this decision to apply for administrative review.

Sorry for that :(

As with any application where a marriage plays a role, the Home Office can always try to cast doubt on the relationship in order to build a refusal case.

This can happen with any application including spouse visa or applications under EEA routes. If there is a doubt on the marriage, they can refuse.

When the applicant has poor immigration history, they tend to put the application under the microscope and anything not strongly demonstrated, can be refuted.

I don't believe in the Admin Review. You are not allowed to add more documents for the Administrative Review. You are merely asking another caseworker to look again and see if initial conclusion wasn't flawed.

You probably need to apply again but strongly demonstrating that your relationship is genuine, lasting and not only made up to facilitate your immigration back to the UK.

Thank u for your reply I applied Administrative Review 8th Oct 2020,still haven't got any response
Can you just tell me for how many days it will take
And one more thing my previous immigration history
Is I overstay for 2 years but I left the county and they said you could may face ban 1 year

My overstay duration is October 2016 to Jan 2019
But I left the country voluntery and paid ticket my own expenses and voluntery team they send me letter it says you could may face ban upto 1 year
