Housing HMO question

Post by Londonjay111 » Sun Jan 17, 2021 3:34 pm

Hello. This is my first post here so please be kind.

I am a British citizen and my husband is American and currently in the USA. We are in the process of compiling documents for his visa application.

My question is regarding accommodation. I currently rent a large room in a shared flat with three others (so four in total), the landlord is happy for my husband to move here and is happy to provide a letter saying he is happy for my husband to come here. However use the rules of HMOs currently the house does not have to have a HMO licence. If my husband moves here, there will then be five people here and so as I understand it it will.

We are getting a housing report from a chartered surveyor and will provide a letter from the landlord saying he has no objections. Will this be okay or will the lack of HMO registration cause an issue.

The place has 5 bedrooms and so overcrowding isn't an issue.

Please help thank you.

Thank you. I'm familiar with the rules about large HMO and HMO etc, what I'm asking is will the home office refuse an application as the property isn't registered or is that not something they check providing the surveyor certifies it is not overcrowded and the landlord has no objections?

I do not believe application will be refused on this basis as long as the inspection report shows that the accommodation is not overcrowded.
My opinions should not be constituted as an immigration or legal advice.
