Tier 2 General Dependent to Skilled Worker Visa

Post by sabikhi » Thu Feb 11, 2021 11:44 am

Hi Board Member,

I need some informtion on my ILR eligibity.

History:-
We moved to UK in December 2014 under Tier 2 ICT Visa with me being the main visa holder and my wife and son being dependent.
Then in June 2016, My wife switched her visa to Tier 2 General.
Me and my son moved to Tier 2 general dependent category in Feb'2017
Our second child was born in the UK in Nov' 2018.

I am aware that:-
My wife will be eligible for ILR in June 2021 [ 5 year rule]
My second child(born in YK) can naturalize to british citizen ship as soon as my wife gets ILR i.e. June 2021.
My son and I will only be eligible for ILR next year (Feb'2022)

I have an option of getting a 'Skilled Worker visa (formerly known as Tier 2 General leave to remain)' from my office now to cover for the interim period.

Question:-
If I switch to the Skilled Worker visa, will my time as a dependent count towards ILR? In other words will I still be able to apply for ILR next year (Feb'2022) or the clock will reset?

Thanks,
RS

If you switch to skilled worker, then no, your dependent visa time does not count towards ilr based on 5 years residence as a skilled worker. Your 5 year ilr clock resets.

Thanks for this information.

I'll better extend the dependent permit by a short duration and apply for ILR after that.

Further questions:-
1. Under what category will my renewal go?
2. What will be the process for renewal? Do I have to wait for my wife to get ILR and then apply for dependent permit or we can put both applications together? Is there any resource which can tell the detailed process and costs associated with it?

Thanks,
RS
