ILR for dependent of a settled person in UK via SET(LR)

Post by kobi » Sat Apr 24, 2021 8:50 pm

I came to UK in Oct'2010 on Tier 2 (ICT) Established Staff visa and since then I got extensions with no breaks. Hence I got ILR in 2021 via SET(LR) application. {I delayed applying for ILR due to Life in UK test}

I got married in 2014 and my wife entered UK under T2 (ICT) Long term Staff partner and since then her visa got extended along with my visa extensions.
Currently she holds Residence permit (BRP) of type: PBS Dependent Leave to remain with validity until March'2022.

My questions:
1) Can she apply for ILR as a partner of a settled person (as I got ILR now)?
2) If yes, which application form to use?
3) If no, we are planning to go out of UK in Aug'2021 on vacation. What should I do so that she is legally allowed to enter UK then?
4) Can we apply extension of my wife's current visa in 2022 till 2024 (until she completes 10 yrs) if I stay in the same company?
5) When can she apply for ILR and using which application form?
6) My child is born in UK in 2016 but I don't want to apply for naturalization yet. So what type of visa should I apply for my child? {Their current BRP is same as my wife's}

1. No she cannot.

2. She can't. She has to switch to FLR M spouse visa meeting the English Nd financial requirements. Her 5 year ilr clock will reset to zero.

3. Apply for FLR M as soon as possible.

4. No, she cannot extend her PBS dependent visa if you got ilr based in long residence.

5. 2024 on set LR if she meets the requirments

Thank you for your prompt and swift reply.

As my wife has already completed 6.5 yrs in UK, if we apply for FLR(M) twice, can she not apply for set(lr) in next 3.5 yrs instead, as she’d have lived in uk for 10 yrs legally?
Secondly, if we decide not to go on vacation in Aug, then can we only apply FLR(M) once in march’2022 and reach to 10 yr mark by 2024 so that we can apply via set(lr)?

Do I have to apply the same FLR M or add my child as dependent in my wife’s application if I don’t want to apply for naturalisation?
