Work Visa

Post by Double D » Sun May 02, 2021 5:47 pm

Hello all

I came to the UK in 2018 on a spouse visa, unfortunately my wife and I separated. She cancelled my visa and i was told to leave the country in December but im still here. My visa will expire in July. How easy is it to apply for a work visa since I am an Engineer?

Will appreciate your response.

Who told you to leave the UK?

Did you get a visa curtailment letter from ukvi stating by when you have to leave?

You need a ukvi approved sponsoring employer for a skilled worker visa.

And what date did the letter state your visa is curtailed to and by which date you have to leave?

I was told to leave in 14 days, which was in January 2021. Could I have breached the conditions?

Thanks

Then you likely currently have no visa status if your visa was curtailed and you would be an overstayer.

Why did you not leave by the date you were told to leave?

Can you post exactly what the ukvi letter said?

My wife left because of arguments we were having. Immediately she left, I applied for ILR domestic violence route coz someone told me that I would be given. After 1 month I received a curtailment letter saying that my visa had been curtailed and I had 14 days in which to leave the country or apply for a different visa. Since I already had a job, I thought to continue working but my employer laid me off. I was hoping that I would find another job through a UK sponsor.

It would be useful if you post the contents of the letter from ukvi, word for word.

It is important to understand to what date your visa was curtailed, ie last date of new visa expiry if you expect any advice. If your visa is curtailed by UKVI, then you don't have a visa that expires in July.

If you were told to leave, you should have left.

I do not have the letter at the moment coz I am away from home. I wanted to see if I could apply for a work visa but I guess they would deny me coz I am potentially an overstayer? I guess i made a mistake applying for ILR.

For ilr based on domestic violence, substantial evidence in support is required. You cannot apply and simply say you are a victim.

If your visa was cancelled, then yes you are an overstayer, which would likely prevent you from applying for another visa while in the UK. It could also cause you to have a ban on returning to the u
