Spouse Visa Application -- Questions

Post by klownking » Thu Oct 21, 2021 4:21 pm

Hi All,

I am going to apply for my wife's spouse. She is in Pakistan right now. I would appreciate that if you can please answer the following questions:
  • She is previously divorced in Pakistan, do I have to mention that in the application or not? I have already registered her documents (ID & Passport) in my name.
  • She studied for her bachelor from Pakistan Honours Degree. Does she have to take the English language test or not? If not then, do we need to get the Pakistan degree approved or something?
I would appreciate your response.

Thanks

1. She will be required to submit proof of divorce to prove to UKVI that she was free to marry. So yes, the form asks if she was previously married and she must declare it

2. A foreign degree will need the ecctis assessment, which is the new naric service basically.

Hi CR001

Thanks for your reply.

In the Govt marriage certificate, it is stated that she is unmarried (pre-marriage status). Would that be enough? The divorce happened a few years back and don't think there are any documents related to this?

Thanks

She needs the divorce papers as prove she was free to marry. This is mandatory for applicants and sponsors who have been married previously.

When I applied for my ILR I mentioned my status as single. Even though I was married. Would this cause an issue?

Can we have another govt affidavit to say she was free to marry?

Thanks

Unlikely however it is never good to withhold information from UKVI as they cross reference everything.

She needs the court divorce decree
Thanks

She doesn't have a divorce certificate. I think I should ask a solicitor for this.

Thanks, CR001.

Hi,

I have got the Computerized Divorce Certificate of my wife and I have also asked the guys to modify the Computerized Merriage Certificate. This should be fine for her.

Now the problem is, when I apply for the ILR I was a divorcee in Pakistan and the divorce was not registered in the Pak union council as it was just had the NADRA record. I had no idea at that time that I had to show the current status and I mentioned Single in my application.

All my applications in the UK I declared single and now I am a bit confused.

My Marriage Certificate shows single for me. Should I declare my divorce or not? I would appreciate any help.

Thanks
