Tier 2 General PBS Dependent Visa Extension and IHS

Hi Team,

Good Day!

I am PBS dependent of my wife who got Tier 2 General Visa for 5 year from Feb 2017 to Mar 2022. She has applied ILR now and decision is pending and its Standard Processing so 4-6 months waiting.

I become her PBS dependent on Sep 2017 so I spent 4 years and 3 months as PBS dependent, I still have 9 months to apply my ILR

we have child born in UK and become dependent in August 2019.

Considering myself as Dependent Partner and child as dependent Children have to extend as I still have 9 months to spend to complete 5 years and child cant register MN1 as wifes ILR is pending and decision wont come before both of our visa expiry which is Mar 2022 (Same as main applicant)

I have got few questions based on above details.

1. Considering I have spent 4 years and 3 months, Do I still need to extend for 3 years? or Home office will only grant for one year to reach 5 year period.
2. if I have to extend more 3 year then would IHS also be 3 years?
3. if IHS is charged for 3 years can this be claimed back/ refunded when I get ILR after 9 months?
4. on IHS payment website it asks Work Start Date and Work End date of Wife(Tier 2 General Visa Holder) as I am her dependent. What date shall we enter as she got CoS with date Feb 2017 - Mar 2022 and now she applied ILR so no other CoS. Based on this what will be start and end date to fill? if I enter CoS dates which is almost close Mar 2022 it may calculate incorrect amount.

Please help

1. It is 3 years as stated in the immigration rules.

2. Yes.

3. Unlikely https://www.gov.uk/healthcare-immigrati ... on/refunds
You will not get a refund if:

your visa application is successful but you do not come to the UK
you leave the UK before your visa ends, for example to make a new application
you’re told to leave the UK before your visa expires
you’re applying for indefinite leave to remain
4. Put a date you apply plus 3 years.

You should apply nearer your visa expiry date. Likely your spouse will have ilr by then.

Your UK born child does not need to apply for an extension.
