Child Citizenship

Post by arunradphy » Tue Jan 04, 2022 2:31 pm

Hi there,
My son born in India (2018) at the of ILR visa for me. I have acquired British citizenship after that and they he came here with family visa (2.5 years route). My wife has Indian passport with family visa. Just wondering whether my child (3 years old) can apply for British citizenship now instead of applying another family visa process. I appreciate your replies, Thanks

No. The child will follow the same immigration path/route as your spouse, ie extension for 2.5 years and then ILR before you can Register the child as British.

For children born abroad, either one parent must be British or applying at the same time as the child and the other parent must hold ILR. A child born abroad is also expected to ILR first.

Children born abroad to non-British parents at the time of their birth follow the same pathway as the second/less-privileged parent and are expected to apply for ILR along with the second parent before registering to become a British citizen.

Have the child been born in the UK after you got ILR, they would have been born a British citizen.
