Adult Dependency visa for Mother in South Africa

Adult Dependency visa for Mother in South Africa

Hi

My mother in South Africa has just lost her husband to cancer. She now in a situation thats quite difficult for her to stay there and was wondering how stringent it would be for her to get to come to the UK to live with me.

Fact of her situation:

She is 77 years old and retired with no income. She has some funds coming from her husbands passing but it wont amount to a whole lot. Not enough for her to maintain a basic standard of living for more than a couple of years.

She lives on an isolated farm and my main concern is her age and been alone. Farm murders and attacks on the elderly in South Africa are very high unfortunately.

She cant afford to move to a home either.

She is on a South African passport.

Her health is ok, she can get around although considering her age I expect it will get worse with time.

I am fully employed and living in the UK since 2015. I am on an Ireland passport.

I can afford to take care of her easily if she resides with me. At my own cost.

Is there any recourse to get her here on an Adult Dependency visa or any other promising route to get her here at all?

Unfortunately under the circumstances you describe it is unlikely that your mother will be eligible for an adult dependent relative visa. The conditions are very onerous. Read the guidance, especially p12-13:

EU SS route as OP has an Irish passport??

Indeed, the OP's mother (SA passport) may be eligible for a EUSS Family Permit provided she is dependent on the OP (Irish passport, UK resident since before 31 Dec 2020).

The rules for dependent parents require the dependency to be evidenced by:

having regard to their financial and social conditions, or health, the applicant
cannot meet their essential living needs (in whole or in part) without the
financial or other material support of the relevant EEA citizen

Note that it is not necessary for the Irish citizen OP to have status under the EUSS.

I thought Irish citizens do not require SS?
