ILR 5 year route. Spouse visa

Hi everyone!

In advance deeply apologies if this question has been answered before, for some reason I can’t find the answer anywhere on the internet.

I have arrived in the UK on May 2023, spouse visa. Now 5 years later May 2023. Im due to apply for my ILR. My BR runs out on September 2023.

Question - Am I eligible to apply for my ILR now (May), or do I have to wait to my BR date? ( September)

You can apply now, assuming your correct date of entry is may 2018 and you meet all the requirements.

The latest you can apply is before you brp expiry date.

You are eligible to apply from 28days before completing 5years since entry UK on initial spouse visa till September 2023 when your current leave runs out.
